ICO Breach Statistics 2012

In 2012 the ICO (Information Commissioner's Office) in the UK found 5 websites to be in breach of  data protection act.

The ICO lists the actions that it takes against organizations that it deems to be in breach of the Data Protection act. This also serves as a useful source of statistical information which this blog entry briefly explores. There are a number of different actions that the ICO can take.
  • Monetary Penalty Notices, 
  • Undertakings
  • Enforcement Notices
  • Prosecutions

Overall Statistics

For 2012 here are the overall statistics.

There were 62 incidents of which 5 relate to websites. Given the number of online applications that process personal information, 5 seems to be a remarkably small number.

Here is a high level overview of the web application incidents.

Monetary Penalty:
  • 6th August: Sensitive personal information relating to 1,373 employees was published on the  website.
Undertakings:
  • 1st March: Disclosure of personal information in training materials published on its website
  • 17th April: a web design error that created the potential for unauthorised access to individual’s personal data 
  • 18th April:  Two data security incidents which relate to the unauthorised disclosure of personal data on the data controller’s website.
  • 30th November: A private area on the website was accessible to members of the public

The Rest of the Incidents

The rest of the cases are made up of a mixture of the usual suspects:
  • Information being sent to the wrong recipient. 
  • Paper files left in waste bins. 
  • Unencrypted memory sticks. 
  • Hard drives not securely erased at end of life.
  • etc.

It is worth taking a look at the ICO website taking actions page to get a feel for the kind of problems that exist. There is no real pattern. Website issues are only a small proportion of the overall numbers. It shows how difficult it can be for a security manager to put a comprehensive security program in place.

Data Deletion and DFDs


The Information Commissioner's Office (ICO) in the UK just handed out a £325,000 fine to  Brighton and Sussex University Hospitals NHS Trust after decommissioned hard drives were sold on eBay. Basically drives containing very sensitive information which were meant to have been destroyed, somehow found their way onto eBay. The NHS trust is appealing the decision.

When creating your Data Flow Diagrams (DFDs) you should also think about secure deletion of data from devices when they have reached the end of their life. In addition to asking how data is stored on devices, you should also ask what happens to these devices (hard drives etc.) when they have reached the end of their life.

Make sure to have proper procedures in place to prevent this kind of thing happening.

Tuesday Top Tip - EU Cookie Directive Deadline in the UK Fast Approaching


If you are in the UK, you have four days to become (finally) compliant with the EU cookie directive. The (real) deadline is May 26th 2012. A year ago, the Information Commissioner gave you a year to comply. So what to do?

Approach 1 - Information Commissioner's Office - ICO

A relatively simple approach is to copy the approach taken by the Information Commissioner's office (ICO) itself. Go to the ICO  website and you will see the following at the top of the page.


You can click on the "I accept cookies..." button to accept cookies. If you don't click, each time you go to the site you will see that message. If you do click, then you won't see it again.

Approach 2 - BT

A more comprehensive approach comes from BT. When you go to the BT website, you will be prompted with the following window


If you click on the Change settings, you are presented with the following which allows you to set the level of cookies that you will accept using a drag bar. You then choose Save and Close.



So those are two approaches. The ICO one is more simple and might be easier to implement in the short term. The BT approach is more elegant but would take longer to implement.

Toshiba UK, ICO and OWASP Top 10 A4 error

The UK Information Commissioner's Office (ICO) has ruled that Toshiba UK breached the UK Data Protection Act by publishing the personal details of 20 competition entrants on its website. According to The Register:
  • "A security fault with the incremental numbering of the competition entrants registration URL created the potential for access to other customers' personal data for a two-month period," the regulator said.
By changing the values in the URL, it was possible to see the details of other users. It looks like this was an OWASP Top 10 2010-A4-"Insecure Direct Object References" issue.

When designing your own application you need to perform authorization checks to ensure that the user has permission to access the requested resource. The OWASP Top 10 gives more guidance on how to implement this.

It's surprising how few of the ICO undertakings are related to web site issues. You can look at the ICO's "Taking Action" page to get a feel for what type of issues cause problems.

ICO Taking Action - 2011 Analysis

Summary
I did an analysis of the UK's Information Commissioner's (ICO) "Taking Action" incidents for 2011. There were approximately 80 incidents  where the ICO took action, after personal data breaches. Of these:
  • 26 were related to  unencrypted media (e.g. lost or stolen laptop or USB memory stick); 
  • 24 were caused by a misadventure of some sort with paper records; 
  • 14 resulted from data being electronically sent (e.g. email or fax)  to the wrong recipient;
  • 12 came from an application or website issue; 
  •  4 were categorised under "other".
The lesson for security managers is that most incidents involving personal data are caused by relatively mundane type events, not advanced hacking attacks. Security awareness training for people should reinforce the message: be careful when processing personal data and do not use USB sticks. Technical measures include encryption of laptops etc.

Detail
The UK's Information Commissioner (ICO) lists the actions he has taken against individuals or organisations found to have been in breach of the UK Data Protection Act. I did an analysis of the incidents for the year 2011. The main purpose is to analyze the causes of these incidents to gather metrics.


I divided the incidents into 5 categories:
  • Unencrypted Media - this includes such items as loss or theft of unencrypted media such as USB sticks or laptops. 
  • Loss of Paper Records - including incidents where physical documents are misplaced, lost, found in a waste bin, or similar.
  • Electronic Records Missent - where personal data is sent electronically to the wrong recipient using either email or FAX
  • Website/Application Issue - where the action results from some sort of application or website issue.
  • Other - which did not fit into any other category
Results
The following table shows the results:

The ICO does not usually say whether an actual loss occured as a result of any incident. There are a number of incidents where you get two for the price of one. For example a laptop is stolen along with paper records.

The results show that the majority of incidents have  relatively simple or mundane causes. Advanced hacking techniques were generally not employed. The lessons to be taken from this analysis are that basic security measures will prevent the majority of these incidents:
  • Security awareness training to reinforce the message that people should be careful when pressing the send button.
  • Do not use USB sticks
  • Encrypt laptops (and USB sticks if they must be used)

ICO Website and Cookies Law - Strange

The new cookies law comes into force in the UK today, although the ICO (Information Commissioner's Office) is allowing one year to comply with the new rules. The purpose is to ensure that:
  • "businesses and organisations running websites in the UK need to get consent from visitors to their websites in order to store cookies on users’ computers. "
How the ICO does it 
The  ICO on its website shows how it could be done - and it's strange. If you visit the website you are shown a fairly ugly header at the top:









It gives you an option to say "I accept cookies from this site". So the first thing that strikes you is why is there is no option to say:
  • "I DO NOT accept cookies from this site."
The ICO site uses Google Analytics to track visitors. You can go to the ICO Privacy Notice page and follow a link which allows you to download an AddOn from Google which might allow you to disable the cookies....but I doubt if many users will go to the effort of doing that.

Fiddler shows me that if I don't click on the "I accept cookeis from this site" header and just leave it there, no traffic goes to Google Analytics

So in effect, if you don't want to accept ICO cookies, the best thing is leave the header on top of the screen and not to click it. Just ignore it.

In addition I use Firefox 4 and I have set the option
  • Tell web sites I do not want to be tracked
 This is under "Tools!Options!Advanced!General". This sends a DNT request in the Request Header. So ideally the ICO should honour that and should never ask me in the first place whether I want to accept cookies.


Conclusion
The way the ICO website implements the new cookie law is not elegant.

ICO Data Protection Principles and Online Applications

Schedule 1 to the UK Data Protection Act lists 8 data protection principles. You can read more on the Information Commissioner's Office (ICO) website here. If you are developing an online application which processes personal information what are the implications?

This blog entry delves a bit deeper.

Privacy Notice

First, a short discussion about the "privacy notice". According to the ICO, this is the notice "that individuals are given when information about them is collected". Typically you will display it on your website.  The ICO has issued a Privacy Notices Code of Practice  "to help organisations draft clear privacy notices and to ensure they collect information about people fairly and transparently".

Having a proper "Privacy Notice" in place is the main step you can take in adhering to a number of the Data Protection Principles.  So one of your first tasks is to develop an appropriate Privacy Notice and then to adhere to it.

Data Protection Principles

The following sections lists the principles and the implications they may have for your online development.

Principle 1
Personal data shall be processed fairly and lawfully and, in particular, shall not be processed unless –

(a) at least one of the conditions in Schedule 2 is met, and

(b) in the case of sensitive personal data, at least one of the conditions in Schedule 3 is also met.

Implication: Have an appropriate Privacy Notice in place.

Principle 2
Personal data shall be obtained only for one or more specified and lawful purposes, and shall not be further processed in any manner incompatible with that purpose or those purposes.

Principle 3
Personal data shall be adequate, relevant and not excessive in relation to the purpose or purposes for which they are processed.

Implication: Have an appropriate Privacy Notice in place.

Principle 4
Personal data shall be accurate and, where necessary, kept up to date.

Implication: The application will need to be able to provide users with access to their personal information. The application should also have a mechanism to allow personal information to be updated. For example, if a user moves home, the application should have a facility in place which supports address updates. Either the user does this themselves directly by logging on, or a Customer Services Agent has the ability to do this on behalf of the customer.

Principle 5

Personal data processed for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

Implication: This should be covered under a data retention policy. The application will need a manual delete function which removes a user's personal information. Either the user does this themselves directly by logging on, or a Customer Services Agent has the ability to do this on behalf of the customer.

The application may also need an automated delete mechanism which automatically erases customer information after a certain period of time or inactivity.

You need to be careful about this principle as it may conflict with other requirements which force you to maintain records for a certain minimum period of time. This could especially be the case with financial transactions.

Another tricky area is audit trails. How long should they be retained for?

Principle 6
Personal data shall be processed in accordance with the rights of data subjects under this Act.

Implication: Have an appropriate Privacy Notice in place.

Principle 7
Appropriate technical and organisational measures shall be taken against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data.

Implication:  This is where the main information security good practices come into play. These include topics such as authentication, authorisation, encryption, audit trail, OWASP Top 10 etc. The Security Requirements section of the SDLC Quick Reference is essentially aimed at trying to meet the requirements of this principle.

Principle 8
Personal data shall not be transferred to a country or territory outside the European Economic Area unless that country or territory ensures an adequate level of protection for the rights and freedoms of data subjects in relation to the processing of personal data. 

Implication:  Before transferring personal data to a third country, you need to ensure that the third country has adequate levels of protection in place.  You need to be careful about using real personal information in development and test environments - especially if you outsource development to third parties.

Subject Access Request

One of the main rights which the UK Data Protection Act gives to individuals is the right of access to their personal information. A user can send a Subject Access Request  requiring you to provide them with a copy of the personal information that you hold about them.

Implication:  Your application should provide functionality which supports this requirement. When a Subject Access Request arrives, your application should have a function which can return all information for that user.

UK Information Commissioner (ICO) Enforcements and Website Hacks

Summary

I did a brief analysis of the enforcement notices that have been handed out by the UK Information Commissioner (ICO) to organisations found to be in breach of the Data Protection Act. The idea was to see how many incidents were a result of a website hack (SQL Injection, XSS etc.)  About 100 enforcements are listed on the  ICO website covering the period from January 2008 to August 2010.

I found that none of the breaches were the result of a website hack. No SQL injection, XSS, CSRF attacks etc. The vast majority were related to unencrypted USB sticks, CDs, laptops etc. which have been lost or stolen.

Details

The Information Commissioner's Office (ICO) is responsible for the enforcement of the Data Protection acts (as well as other legislation) in the UK.

The ICO Enforcements page contains a list of enforcement notices that they have undertaken against organisations found to have been in breach of Data Protection legislation. The notices generally contain a short description of the breach as well as the remedial action which the implicated organisation undertakes to implement.

What is of interest from a web application security perspective is an analysis of the security incidents to see how many were caused by a website vulnerability - basically whether a website had been hacked.

I did a brief (not-very-scientific) analysis of the enforcements which have been published on the ICO website and focussed on the description of the breach.There were slightly fewer than 100 enforcements between 16 January 2008 and 26 August 2010. 

I categorised the incidents as follows:

Unencrypted Media is where an incident occurred following the loss or theft of a device which contained personal information and was not encrypted. This could be a laptop, CD, USB memory stick, old hard drive etc. It also includes a number of cased where users sent out unencrypted emails to the wrong recipient. For example the Royal Wolverhampton Hospitals NHS Trust enforcement has the following description :
The report concerned an unencrypted CD, with no password protection, which contained scans of patient charts from the Intensive Care Unit of the data controller's Heart and Lung Unit, and was allegedly found at a bus stop near the data controller's premises and passed to the newspaper anonymously."

Loss of Paper Records covers incidents where paper records were involved. This could be where patient records were found in a waste skip etc.. An example is the NCL (Bahamas) Ltd  which suffered a theft where:
the printout contained names, addresses, dates of birth, National Insurance numbers, salary details and full bank account details for around 80 employees."

Website Hack includes situations where a website was hacked. We would expect to see OWASP Top 10 type vulnerabilities being exploited which resulted in a breach of personal data.

Others is a catch-all for other types of incidents described in the enforcements. This could be where the organisation processes personal data in an unfair manner. For example they collect too much data.


Results

Here are the results of the analysis of the approximately 100 enforcements:

A number of points to note. None of the incidents resulted from a website hack. No SQL Injection. No XSS. No CSRF. The vast majority resulted from the loss of an unencrypted device - or similar.

Can we conclude that OWASP (in the UK at least) can pull down the shutters - a job well done?  Probably not. 

But if I were an information security manager trying to prioritise the following projects:
  • Do something about web application security
  • Do something about USB/laptop encryption
Guess which one would go in second place.

Notes:

The numbers are approximate because in some cases the incident will have two causes. In other cases, a single enforcement notice covers multiple incidents.

There is not yet a requirement to notify the authorities of a data breach. So the figures probably do not tell the whole story.
